Rules of origin in the Vietnam-South Korea Free Trade Agreement

The Ministry of Industry and Trade has issued Circular No. 40/2015 / TT-BCT regulating the implementation of rules of origin in the Vietnam-South Korea Free Trade Agreement.

Within the framework of the Vietnam-Korea Free Trade Agreement (VKFTA), goods imported into the territory of a Member are deemed to have origin and are eligible for preferential tariff treatment if the goods It meets one of the following rules of origin:

Wholly-Obtained or Produced in the territory of the exporting Party;

It is not wholly obtained or produced wholly in the territory of the exporting Member State, but which does not meet the requirements of origin; Rule-specific items; Regulations for special and aggregate goods;

Produced entirely in the territory of the exporting country only from materials originating in Vietnam or Korea.

Goods eligible for tariff preferences should meet all the provisions of this Circular and be transported directly between the territories of the member countries.

Where the goods being transported from the exporting Member to the importing Member State must transit through one or more countries not members of the VKFTA Agreement outside the territory of the Member States, It is considered as direct shipping, provided that:

Transit is necessary due to geographical reasons or due to requirements specifically related to transport;

Goods are not involved in trade or consumption in the transit country;

The goods do not undergo any other procedure, except unloading and reloading or the steps necessary to preserve the goods in good condition.

Have a certificate of origin for goods to enjoy preferential tariffs.

In order to enjoy preferential tariffs, goods must have a certificate of origin (C / O) in the prescribed form. Each Member shall maintain the registration and updating of the list of names and specimen seals of the C / O issuer of that Member.

The list also includes the list of 21 C / O issuers in Vietnam, including the Hanoi Regional Export Administration, Ho Chi Minh City, Da Nang, Dong Nai, Hai Phong, Binh Duong, Vung Tau, Lang Son, Quang Ninh, Lao Cai, Thai Binh, Thanh Hoa, Nghe An, Tien Giang, Can Tho, Hai Duong, Binh Tri Thien, Ha Tinh, Khanh Hoa, Ninh Binh and Industrial Zones Authority And processing in Hanoi.
